The terms that govern your access to and use of the BuildersAlpha website and platform.
These Terms of Service ("Terms") govern access to and use of the BuildersAlpha website, platform, and related services (the "Services") provided by BuildersAlpha, Inc. ("BuildersAlpha", "we", "us"). This summary is provided for convenience and is not a substitute for legal advice; for customers, an executed order form or master agreement controls where it conflicts with these Terms.
By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.
"Customer" means the organization that subscribes to the Services. "Candidate" means an individual invited to take an assessment. "Customer Data" means data submitted to or generated within the Services, including assessment content and results.
You must be at least 18 years old and able to form a binding contract. You are responsible for safeguarding credentials and for activity under your account. Enterprise access is managed through SSO and role-based controls.
BuildersAlpha provides an AI-native assessment platform that evaluates how candidates build with AI and produces scores and intelligence reports. Assessment outputs are decision-support tools; the Customer is solely responsible for its hiring decisions and for using the Services in compliance with applicable employment and anti-discrimination laws.
You are responsible for providing required notices to and obtaining any necessary consents from candidates, for the lawful basis of processing candidate data, for configuring assessments appropriately for each role, and for the accuracy of data you submit.
You agree not to misuse the Services, including by attempting to defeat anti-cheat or security controls, reverse engineering the platform, reselling access without authorization, uploading unlawful or infringing content, or using the Services to discriminate unlawfully. We may suspend access for violations that pose a security or legal risk.
Fees are set out in your order form. Unless stated otherwise, fees are billed in advance, are non-refundable except as required by law, and exclude taxes. Late amounts may accrue interest and may result in suspension.
BuildersAlpha and its underlying technology, content, and trademarks are owned by BuildersAlpha. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain rights in Customer Data and grant us the rights necessary to provide the Services.
Each party will protect the other's confidential information and use it only to perform under these Terms. Custom challenges and private question banks are treated as Customer confidential information, and assessment materials are our confidential information.
Our processing of personal data on your behalf is governed by our Privacy Policy and Data Processing Agreement, which is incorporated by reference for customers. Security practices are described in our Trust Center.
The Services may integrate with third-party products (such as your ATS or identity provider). Your use of those products is governed by their terms, and we are not responsible for them. Our subprocessors are listed on our Subprocessors page.
We provide the Services with reasonable skill and care. Except as expressly stated and to the maximum extent permitted by law, the Services are provided "as is" without other warranties, and we do not warrant that assessment results will be error-free or fit for any particular hiring outcome.
To the maximum extent permitted by law, neither party is liable for indirect, incidental, or consequential damages, and our aggregate liability arising out of the Services is limited as set out in your agreement (or, absent one, the fees paid in the 12 months preceding the claim).
Each party will defend and indemnify the other against third-party claims to the extent arising from its breach of these Terms or violation of law, subject to the limitations in your agreement.
These Terms apply while you use the Services. Subscriptions run for the term in your order form. Either party may terminate for material breach not cured within a reasonable period. On termination, your right to use the Services ends and Customer Data is handled per your agreement and our Privacy Policy.
These Terms are governed by the laws specified in your agreement, or otherwise by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. The parties will attempt to resolve disputes in good faith before pursuing other remedies.
We may update these Terms from time to time. Material changes will be communicated, and continued use after the effective date constitutes acceptance.
