Privacy Policy

How BuildersAlpha collects, uses, shares, and protects personal information across our website and platform.

This Privacy Policy explains how BuildersAlpha, Inc. ("BuildersAlpha", "we", "us") handles personal information when you visit our website, request a demo, or use our assessment platform. This summary is provided for transparency and is not a substitute for legal advice; the controlling terms for customers are set out in your agreement and Data Processing Agreement.

1. Who we are and our role

For information collected through our website and marketing, BuildersAlpha acts as a controller. For candidate assessment data processed on behalf of a hiring organization, BuildersAlpha acts as a processor, and that organization is the controller responsible for the lawful basis of processing.

2. Information we collect

We collect the following categories of information:

3. How we use information

We use information to provide and improve the platform; deliver and score assessments and produce intelligence reports; verify identity and prevent fraud and cheating; communicate with you; provide support; maintain security; and comply with legal obligations.

4. AI and automated processing

Our platform evaluates how candidates work with AI tools and produces scores and reports. Assessment outputs are intended to inform, not replace, human hiring decisions; the hiring organization remains responsible for its decisions. We do not use candidate work product to train third-party foundation models without a lawful basis and appropriate agreements.

5. Legal bases (EEA/UK)

Where the GDPR or UK GDPR applies, we rely on legitimate interests (operating and securing our services and marketing), performance of a contract, consent (where required, such as certain cookies), and compliance with legal obligations.

6. How we share information

We share information with the hiring organization that invited a candidate; with subprocessors who help us operate the service, under contract; and where required by law or to protect rights and safety. We do not sell personal information. Our current subprocessors are listed on our Subprocessors page.

7. International transfers

We may process information in the United States and other countries. Where required, we use appropriate transfer mechanisms such as Standard Contractual Clauses to protect personal information transferred across borders.

8. Data retention

We retain personal information for as long as necessary to provide the service and meet legal obligations. Candidate data retention is configurable by the hiring organization, and we delete data on request in accordance with the applicable agreement.

9. Security

We protect information with encryption in transit and at rest, access controls, isolated assessment environments, and SOC 2 Type II audited practices. See our Trust Center for details. No method of transmission or storage is completely secure, but we work continuously to protect your data.

10. Your rights

Depending on your location, you may have rights to access, correct, delete, restrict, or port your personal information, to object to certain processing, and to withdraw consent. Candidates whose data was processed on behalf of a hiring organization should generally direct requests to that organization; we will assist as a processor. To exercise rights or raise a concern, contact us using the details below.

California (CCPA/CPRA)

California residents have rights to know, delete, correct, and opt out of the "sale" or "sharing" of personal information. We do not sell personal information and do not share it for cross-context behavioral advertising in a way that requires opt-out. You will not be discriminated against for exercising your rights.

11. Cookies & tracking

We use necessary cookies to operate the site and, with consent where required, analytics cookies to understand usage. You can control cookies through your browser settings. See our analytics subprocessors on the Subprocessors page.

12. Children's privacy

Our services are intended for businesses and working professionals and are not directed to children. We do not knowingly collect personal information from children.

13. Changes to this policy

We may update this policy from time to time. We will post the updated version with a new effective date and, where appropriate, provide additional notice.
